Fully Developed Claim filed

Hi all.  I have been reading posts for awhile but this my first post.  I am xurrently 50% service connected for thrombophlebitis right calf with venous stasis disease and lymphedema.

I filed to reopen my claim for an increase in March and for service connection of arthritis in both knees.

Ebennies says:

Status of Your Claim

  • Submitted: 06/01/2017 (Compensation)
  • Estimated Completion: 06/30/2017 - 07/07/2017
  • Disabilities Claimed: Routine Future Exam- right postphlebitic syndrome with chronic lymphedema with recurrent episodes of cellulitis (previously rated as (thrombophlebitis, right calf with venous stasis disease and lymphedema (New)
  • Representative for VA Claims: DISABLED AMERICAN VETERANS
  • Current Status: Preparation for Decision

My question is what does the Routine Future Exam mean?  I had my C and P exam a month ago and the doctor said my claim looks perfect.

TDIU Denied or not?

Hello all! I am new to the forum. I have a question for anyone who has experienced this: I received a SSOC that stated my TDIU claim was denied prior to a certain date due to schedular requirements, and that was basically all the information given. My lawyer thinks TDIU was granted after the date mentioned because if the RO was going to deny the claim entirely there would be no need to mention any date. The claim is still in PDA in Ebenefits and has been for weeks.

Has anyone received this type of ambiguous SSOC before and if so, what was the outcome?

VA Medical Facility (needed)

So today my claim for PTSD had a small update. It's still in the "gathering of Evidence" stage, but the "Needed from Others" changed to reflect "Va Medical Facility". What does this mean? They haven't even requested my private treatment records from the psychologist I meet regularly with. My Dr. was hesitant to give me the records and told me it's customary for the VA to request on their own. I submitted the form allowing my Dr. to release my records, but I haven't seen any activity that would suggest the VA has done so. What am I waiting on now? Any thoughts? Thanks!

Can anyone please tell me if there is a place on ebenedits where it states if i have been approved for tdiu?  My claim is completed and there has been no change in the VA letter or my 80% hasn't changed.  Does this mean that i was denied? Thanks

eBenefits letters contradictory

Hello all!

Has anyone had this happen: I checked ebenefits today on my TDIU claim and while there is no decision yet,  in my VA letters the Benefit summary states:

Summary of benefit information
Include? Information Value
Include the information in this row You have one or more service-connected disabilities: Yes
Include the information in this row Your combined service-connected evaluation is: 90%
Include the information in this row and the one below it
  • Your current monthly award amount is:
  • The effective date of the last change to your current award was:
  • $1748.71
  • April 01, 2017
Include the information in this row You are being paid at the 100 percent rate because you are unemployable due to your service-connected disabilities: Yes
Include the information in this row You are considered to be totally and permanently disabled due solely to your service-connected disabilities: Yes

However the AB8 letter shows: The current benefit paid is as follows: Gross Benefit Amount $1,748.71 Net Amount Paid $1,748.71 Effective Date April 1, 2017 Combined Evaluation 90 percent.

Also, the commissary benefit letter shows: We are providing you with this letter so you may receive commissary store and exchange privileges from the Armed Forces. This is to certify [my name] is an honorably discharged veteran of the Navy and is entitled to disability compensation at the 100 percent rate due to service-connected disability(ies). This total disability is considered permanent. You are not scheduled for future examinations.

These letters contradict each other and the monthly award [and effective date] is wrong if I am being awarded 100%.

Does anyone have any thoughts?

Put in for IU and a few other conditions

I put in for a few conditions in May.  At the same time I also put in for IU, since I lost my job because of my service connected disabilities.  Now I know ebennies isn't very reliable, but I went there to check the status to see if I was getting close.  It moved from "pending decision" to "pending decision approval".  I then checked my letters to see what they say it the letter shows that I was reduced to 80% from 90%.  UGH.  Should I be concerned?  I know I have to wait for the decision letter, but any way I can find out whats going on.  I called peggy and they said I should have a letter by the 20th.

Decision after BVA hearing

What is the timeline for getting a decision if a disability is service connected AFTER a BVA hearing?  Not when the RO rates the decision.  Had my hearing on 8/1, can't find any info on the subject.  Is it true that the VLJ can only handle 15 cases at a time, and that starts once the hearing is held?

Thank you.

Pay adjustment

I'm a retired 21 yr vet and currently at 90%. Well 7 yrs ago I filed an appeal and according to ebenifits it's status is it's with the VA Law judge. The question is a new claim popped up saying CRSC/CRDP New and it says retired pay adjustment. I'm already receiving CRSC/CRDP so what does this mean?

Second request: Medical Opinion Needed??? Anxiety secondaty to Respiratory Disease

Good Afternoon,

I recently noticed an update on my Ebenefits account re: My claim for Asthma, Bronchiecstasis, Aspergilliosis, Sleep Apnea and Anxiety...

I had a c & P exam already (7/19/2017), and per the VA, they already have the progress notes from the doctor and the VA has reviewed it...C & P results received at the VA 8/1/17, and they reviewed them 8/11/17.

Now they updated my claim to: REQUEST #2 from VA Facility. When I called to see if there is anything I can do, or if another C&P is needed, they told me not to worry, because that is an internal request and they are requesting a medical opinion.

But I just received a call from QTC, they want me to come in for Anxiety C & P. What should I expect from this?

I was just wondering if this is normal or if I am getting closer to a decision? VA has been very nice every time that I call them. I always have been respectful and they have been to me as well.

Quick Turn Around in E-Benefits

Have a question. I submitted a claim in E-Benefits for secondary for both my left hip and left foot (due to left discrepancy), which is SC. The plantar fasciitis in my foot was diagnosed by the VA and my hip was diagnosed by a civilian doctor. I uploaded all my VA medical and personal doctors medical evaluation and documents along with a copy of my service medical records. My question is why this was done so fast as my initial claim was put into E-Benefits on  08/02/2017 and now I see its already in the "Preparation for Notification" phase. Also under disabilities claimed it states "mqas review - recoupment adjustment (New)".  I did get an SSB payment when I left the service that I have been paying back for years now. My question is this seems too fast for the VA.....and not a good sign.

No Data on eBenefits

Now I know eBenefits is one of the most frustrating sites in existence so my expectations are pretty low.

I used to be able to go onto eBenefits and at least generate a letter, see my claim upload documents and a few other things.

Now however I CAN'T do ANYTHING. I just get error messages and told to contact the VA for assistance and am provided with an error code or two.

For instance when I try to generate a letter I get:

We are unable to generate your letter due to incomplete information contained in our systems. Please try again later or call VA at 1-800-827-1000 (711 if you use a TDD) and select Option 7, Monday-Friday, 8:00 am - 9:00 pm ET, and provide us with the following reference code so that we may take action to update your records. Provide Reference Code: EVSS-6033, EVSS-1012

When I try to view my disabilities I get:

We couldn't retrieve your disability rating information at this time.
Please try again later or call VA for assistance at 1-800-827-1000 (711 if you use a TDD), Monday - Friday 8:00am to 9:00pm ET. When requesting support, please provide the Error ID : EVSS-1009

I have called the number given and TRY to tell the operator at the other end what I am getting but they never want to hear the error codes, tell me that eBenefits is always going don and that many other veterans are having problems too. The issue never gets resolved.

I hate having to call each time I need an updated letter (Usually because the letter date is too old), find out information on my claim or even try to look up my payment history.

I want to be able to do this online without having to call in each time. Sometimes you can never get through and have to wait for a call back the next day. Rather frustrating.

Is there a "magic" phone number to call to get the issues resolved? Do I have to travel to the nearest Regional Office (Which is quite a distance from me)?

Any guidance would be greatly appreciated.

Had a PTSD/MST claim in for another vet since May. 2 weeks ago, did C&P exam, and up to yesterday EB has been Gathering Evidence.

Yesterday they went to Pending Decision. This AM they were Pending Decision Approval, and this PM they are Prep for notification.

Anyone seen VBA move that fast before or is this a rush to meet end of month deadlines?

Gathering Evidence to Preparation for decision and back

So opened my claim in March of this year and I actually submitted in May. I had my C & P for PTSD on August 8. Before August 8, my completion date was between September 15 to December 11, 2017. After my C & P, my date changed from September 17, to December 12, 2017. This morning, my status was gathering evidence with the same September 17, to December 12, 2017, completion date. At around noon today, my status changed from Gathering Evidence to Preparation for Decision. Since I'm impulsive, I checked again at 3pm today (still August 29, 2017), and my status changed back to Gathering Evidence with a new completion date of December 2, 2017, to February 24, 2018. Also, on my open claims page there is an error that says "Requested Documents are Past Due." They have never requested anything from me, only my private psychologist (which they told me today they had received a 17 page report from already). Is it bad it went back and forth in one day? Any thoughts? Thanks in advance!

retired v VA comp in ebenefits ?

Hi everyone!

80% and filing another claim. I get to this on ebenefits....ummm,
Not sure what to click. 22 years active retired, already above 50% disability. I am sure I am overthinking it.

Side note: i filed for an increase for a claim that was awarded, i uploaded the dbq from civilian doc and a statement from myself and my increase went thru in less than 6 days. Wow

Btw, 2 vso's and 1 yes and 1 no

The question in text format:

Do you want to receive VA compensation instead of military retired pay?  if it is determined you are entitled to both benefits and you want to receive VA compensation instead of military retired pay, select Yes. If you are awarded military retired pay prior to VA compensation , we will reduce your retired pay by the VA compensation amount. VA will notify the Military Retired Pay Center of all benefit changes.

If you receive both military pay and VA compensation , some of the amount you get may be recouped by VA, or, in the case of VSI, by the DOD.

Thank you in advance

UPDATE: My claim went to 'PREPARATION FOR DECISION'

HI All,

I just checked ebenefits and my claim went from Gathering of Evidence to Prep for Decision.

I submitted intent to file on 8/2016, submitted my fully developed claim with all records and diagnosis needed on 7/2017, had a C&P for re-evaluation for Asthma, Sleep Apnea, Bronchiecstatis, Restrictive Lung Diesease, Aspergilliosis on 7/19/2017 at QTC, had another C&P for Mental Health (Anxiety) on 8/9/2017 at QTC.

Today, 9/1/17, it was changed to Prep for Decision.

I just wanted to share the update on my claim with my fellow vets, since this website has helped me a lot and there a lot of good people helping vets here.

Granted it was a re-eval from 60% SC to ???, I think It has been moving pretty fast, just hope that the actual decision phase comes soon.

Can the VA reduce your rating??

$

http://themilitarywallet.com/can-the-va-reduce-disability-benefits/

My summary:

Yes, the VA can reduce your rating if your conditions improved.  However, there are protections at 5 year, 10 years, and 20 years which help shield you.  If your rating is temporary, the VA can reduce you rather easily, but if you are over 5 years or P and T, then its tough for VA to reduce you.

When ever you seek an increase is "NOT" one of the reasons VA can use to reduce you.  Seeking an increase is independent of a rating reduction.  Whether or not you improved, and whether or not your rating is protected is relevant, but seeking an increase is not relevant to reductions.  If you think you deserve an increase, by all means apply.

Can anyone please tell me if this means the re-evaluation is negative I have recently completed a C&P by the VA on a claim already receiving 30% on I am hoping they are not trying to screw me and reduce that claim.

Jeff, I am assuming that you are referring to the E-Benefits page that shows my total disabilty. At the bottom it reads Pending Disabilities status as No Pending Disabilities to display at this time.
